Terms and Conditions

Overview

This Amsaan Tours App (“Application” or “App”) operated by Amsaan Accessible Tours LLC (“the Company” or “Amsaan UAE”). Throughout the application, the terms “we”, “us” and “our” refer to Amsaan Accessible Tours LLC.

These terms and conditions (“Terms of service” or “T&Cs”), together with any Service Order and exhibits (if any), form a legal agreement (“Agreement”) between You (including, if applicable, any legal entity that you represent or act for) (“Customer” or “User”) and Amsaan Accessible Tours LLC and sets forth the terms and conditions governing Customer’s access to and use of the Services (as defined below).

SECTION 1 - GENERAL CONDITIONS

1.1. Amsaan UAE strives to create a holistic ecosystem for people with disabilities in tourism and other sectors, and propose Amsaan Tours App as product which helps and offers its customers the following but not excluding:

  • -  To navigate within their tour, purchased from our partners or us;

  • -  To get acquainted with travel Information and security travel recommendations depending

    on the destination;

  • -  To get access to the online Sign-language interpreter services via Amsaan Tours App;

  • -  To use online Amsaan Tours App chat in order to communicate with other users –

    participants of the particular tour, and Amsaan UAE tour guide or operator;

  • -  To get recommendations about points of interest provided by our partners (third parties);

  • -  etc (hereinafter – “Services").

    1.3. We reserve the right to refuse service to anyone for any reason at any time.

    SECTION 2 - MODIFICATIONS TO THE SERVICE AND PRICES

    2.1. Prices for our services are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

    SECTION 3 - AVAILABILITY OF THE PRODUCTS OR SERVICES

    3.1. Amsaan UAE services provided “as is”, and may be available online through Amsaan Tours App, in particular:

Sign Language Interpreter Services: Within the Amsaan Tours App, users have the option to purchase minutes for a call with a sign language interpreter to receive sign language

1.2. You may not use our application for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction and jurisdiction which governs this Terms of Service (including but not limited to copyright laws).

interpreting services on the following languages: International Sign Language and British Sign Language.

  • Travel Tour Information and security recommendations: Users can access a separate menu within the Amsaan Tours App to find details about particular tour, including itineraries, destinations, and associated information. A general security recommendations for the tours also available for users to review.

  • Recommendations of the Points of Interest: The Amsaan Tours App provides users with recommendations and advertisements for points of interest to visit. Point of interest (“POI”) is considered as any type of location that has a particular Customer (tourist) interest. POIs can be any type of a tourist attraction, restaurant/café, cultural, architectural, or recreational site, scenic spot, etc.

    Please note: while we provide information and recommendations for third-party services, we are not responsible for the actions, quality, or conditions of service rendered by these third parties. Users are encouraged to exercise their discretion when engaging with any third-party services recommended within the app.

Extra Tours Booking: The Amsaan Tours App features an "Extra Tours" menu, which offers additional tour options. Currently, booking extra tours through the app is not activated. Users can book extra tours by reaching out to an operator via the online chat feature.

SECTION 4 - OPTIONAL TOOLS

4.1. You acknowledge and agree that we provide access to our Services ”as is”. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

4.2. We may also change existing or offer new services and/or features via the App. Such changes or new features and/or services shall also be subject to these Terms of Service.

Please also be aware that some features of the App may not be fully available at this time. If you encounter any difficulties or need assistance with the App, we encourage you to reach out to our operator via the online chat feature for prompt support and guidance.

SECTION 5 - THIRD-PARTY LINKS

5.1. Certain content, products and services available via our Service may include materials from third-parties.Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.

5.2. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites or point of interests. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

SECTION 6 - USER-GENERATED CONTENT SAFETY CLAUSE 6.1. Content Filtering and User Responsibility:

  1. The App provides an online chat feature that allows users to engage in real-time conversations with other users, tour guide and/or Amsaan UAE operator. To maintain a safe and respectful environment, users are expected to abide by the guidelines of this Terms of Service when using the chat functionality.

  2. The App employs a robust filtering system designed to identify and prevent objectionable content from being published within the chat. While we make every effort to filter out such content, users are also encouraged to take responsibility for the content they post.

6.2. Flagging Objectionable Content:

  1. We have implemented a feature that allows users to flag objectionable content within the chat. If you come across any content that violates you or our community guidelines, please report it by using the provided reporting mechanism.

  2. Upon receiving a report, our team will review the content within 24 hours. If the content is found to be objectionable, it will be promptly removed, and the user who posted it will be subject to appropriate action, including possible ejection (ban) from the chat and App.

6.3. Blocking/Muting Abusive Users:

a. Users have the ability to block or mute other users if they find their interactions to be abusive or harmful. This feature ensures that you can maintain a positive chat experience by avoiding interactions with those who engage in objectionable behavior.

6.4. Prompt Action on Objectionable Content Reports

a. Our team is committed to addressing objectionable content reports promptly. Upon receiving a valid report, we will take the following actions:

  1. (i)  Review the reported content within 24 hours.

  2. (ii)  If the content is found to be objectionable and in violation of our guidelines, it will be

    removed.

  3. (iii)  The user who posted the offending content may be ejected (banned) from the App

    based on the severity of the violation.

6.3. User Cooperation. We encourage all users to cooperate in maintaining a safe and enjoyable chat environment. Your active participation in flagging objectionable content and blocking abusive users plays a vital role in upholding the standards of our community.

6.4. Fedback and Improvements. We are committed to continuously improving our filtering and reporting mechanisms to enhance the safety of our chat feature. If you have any feedback or suggestions, please do not hesitate to reach out to our support team.

SECTION 7 - PERSONAL INFORMATION

Your submission of personal information through the Amsaan Tours App is governed by our Privacy Policy.

SECTION 8 - ERRORS, INACCURACIES AND OMISSIONS

8.1. Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information if any information in the Service or on any related App, website is inaccurate at any time without prior notice (including after you have submitted your order).

8.2. We undertake no obligation to update, amend or clarify information in the Service or on any related App, website, including without limitation, pricing information, except as required by law.

SECTION 9 - PROHIBITED USES

9.1. In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content:

(a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information;

(g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

SECTION 10 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

10.1. We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely or error-free.

10.2. You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind.

10.3. In no case shall Amsaan Accessible Tours LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred

as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

10.4. Because some jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

SECTION 11 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 12 - TERMINATION

12.1. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

12.2. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our App.

12.3. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 13 - ENTIRE AGREEMENT

13.1. The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

13.2. These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

13.3. Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 14 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United Arab Emirates.

15.1. You can review the most current version of the Terms of Service at any time at this page.

15.1. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our App. It is your responsibility to check our App periodically for changes. Your continued use of or access to our App or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
